Definition
Under direction of the Legal or Deputy Legal Counsel, oversees investigations and work of the investigative staff pursuant to NJSA 19:44A-6b; identifies violations of the Reporting Act and other statutes under the Commission's jurisdiction; is responsible for the legal and factual sufficiency of investigations; recommends prosecution consistent with law, Commission policy and due process; does other related duties.
Examples of work
- Oversees the investigation and review activities to detect and enforce compliance with the New Jersey Campaign Contributions and Expenditures Reporting Act, and other statutes under the Commission's jurisdiction.
- Oversees the conduct of investigations to ensure that alleged violations are supported by sufficient evidence, and that due process requirements for investigative subjects and witnesses are met.
- Conducts investigations and prepares reports as required
- Reviews and evaluates the investigation reports prepared by subordinates; determines whether recommendations are appropriate based on the application of statutes, facts, objectives, Commission policy, and legal sufficiency.
- Reviews, evaluates and provides recommendations for civil and monetary penalties consistent with requirements of the Reporting Act, Commission guidelines, and the factual and legal conclusions of the investigation.
- Develops and implements methods for the conduct of investigations, for the collection and preservation of evidence, for the analysis of financial documents, and for taking witness statements and sworn testimony; alters investigative methods and practices as required by new and/or amended legislation.
- Utilizes computer technology to assist in the presentation and evaluation of financial data collected during the investigation, and in the analysis of multiple contributor information relevant to contribution limit violations.
- Oversees and participates in the preparation of questions and the taking of testimony and witness statements during the course of an investigation.
- Oversees the review and analysis of financial documents.
- Responds to public inquiries; reviews correspondence prepared by investigative staff.
- Oversees a record keeping system for investigations.
- Reviews and evaluates employee performance and conduct, and has responsibility for effectively recommending the hiring, firing, promoting, demoting and/or disciplining of staff.
- Reviews and evaluates requests for investigations submitted by various sources; recommends whether sufficient cause exists to open an investigation.
- Prepares and supervises the preparation of reports and correspondence in the course of official duties.
- Assigns investigative staff.
- Provides status reports on investigations and related activities to executive staff.
- Establishes and maintains liaison and cooperative working relationships with investigative staff of other agencies.
- Plans, develops and conducts audits of candidates, political party committees and lobbyists.
- Reviews and evaluates all investigative subpoenas; trains investigative staff in preparation and issuance procedures; prepares pleadings to be filed with Superior Court in the enforcement of investigative subpeonas and defense against motions to quash investigative subpeonas.
- Appears in Superior Court on behalf of the Commission in connection with litigation of subpeona enforcement matters.
- Conducts legal research for preparation of pleadings in subpeona enforcement matters, and for administrative hearings.
- Prepares complaint pleadings to enforce compliance with the applicable laws and regulations.
- Appears as the Commission's attorney in administrative hearings; prepares motion papers and other documents and presents the Commission's case; engages in settlement negotiations
- Provides assistance to other Commission attorneys as required.
- Will be required to learn to utilize various types of electronic and/or manual recording and computerized information systems used by the agency, office or related units.
Education
Graduation from an accredited law school with Juris Doctor (J.D.) or a Bachelor of Laws (L.L.B.) degree.
Experience
Five (5) years of experience involving the review, analysis, evaluation and interpretation of statutory requirements in a business or government organization, including the audit and/or investigation of their applications and responsibility for enforcement.
License
Appointee must be licensed to practice as an Attorney at Law in the State of New Jersey.
Appointee will be required to possess a driver's license valid in New Jersey only if the operation of a vehicle, rather than employee mobility, is necessary to perform the essential duties of this position.
Knowledge, skills and abilities
- Ability to learn to utilize various types of electronic and/or manual recording and information systems used by the agency, office, or related units.
- Ability to read, write, understand and communicate in English sufficiently to perform the duties of this position. American Sign Language or Braille may also be considered as acceptable forms of communication.
