Definition

Under the general direction of the Director, Workplace Standards, Department of Labor, manages two or more programs of the division involving wages, hours of work, or occupational safety and/or health of employees or the general public; does related work as required.

Examples of work

Initiates, guides, and coordinates inspection or enforcement functions in accordance with the sections of the public law for which the division is responsible. Exercises general direction over managerial personnel and/or other subordinate supervisors in the implementation of enforcement procedures and establishment of evaluative criteria for measuring the effectiveness of the state's programs. Schedules and conducts hearings related to the revocation or granting of licenses and permits. Assists with the formulation of policy guidelines and approves the rules and regulations necessary for implementation. Directs preparation and allocation of budgets and workload goals for assigned units within the division. Represents the Assistant Commissioner or Director during hearings for the review of closure or other punitive actions taken by the division's operating offices against violators of those sections of the public law for which the division is responsible. Plans, develops, and evaluates the effectiveness of forms, methods, and procedures utilized. Oversees the implementation of onsite consultation services in accordance with the United States Department of Labor's Occupational Safety and Health Administration. Maintains liaison with the United States Department of Labor; directs and coordinates investigations for federally funded projects. Directs the work operations and/or functional programs and has responsibility for effectively recommending the hiring, firing, promoting, demoting, and/or disciplining of employees. Represents or designates subordinates to represent the department on intrastate, interstate, national, and international councils concerned with the development of work standards in all industries including migrant workers in the farm industry. Evaluates the impact of proposed state and federal legislation; provides advice and recommendations to the Director. Reviews and evaluates information and evidence derived from field reports, complaints, and other sources; determines the validity and disposition of such information. Interprets the labor laws of New Jersey relevant to various employer/employee situations and/or the safety of the public at large. Reviews applicable statutes, rules, regulations, standards, policies, and procedures; provides recommendations for revisions. Plans, organizes, conducts, and supervises studies and surveys. Directs the preparation of interpretative regulations, booklets, and other factual materials. Addresses lay and professional groups concerning those provisions of New Jersey's laws administered and enforced by the Division. Coordinates federal funding and provides for proper accounting of such applicable funds. Directs the various office functions of the organizational sections. Delegates appropriate assignments, provides instruction and supervision to technical, investigative, clerical, and other staff. Establishes and maintains cooperative working relationships with other management employees within the department, and with those groups interested in or concerned with the work of the office. Prepares extensive correspondence in the course of official duties. Directs the preparation of complex and detailed analyses and reports containing findings, conclusions, and recommendations. Directs the establishment and maintenance of essential records and files. May be required to learn to utilize various types of electronic and/or manual recording and information systems used by the agency, office, or related units.

License

Appointees will be required to possess a driver's license valid in New Jersey only if the operation of a vehicle, rather than employee mobility, is necessary to perform the essential duties of the position

Knowledge, skills and abilities

Knowledge of administrative problems encountered in developing appropriate guidelines and procedures for use in enforcing the public laws for which the division is responsible. Knowledge of the problems implicit in developing and executing plans for the effective utilization of available funds, personnel, and related activities. Knowledge of current budget system. Knowledge of state and related federal laws and appropriate rules and regulations relevant to the occupational health and safety of employees and the general public and/or wage and hour compliance program elements after a period of training. Knowledge of the economic and related problems of urban and rural industry in New Jersey, and of current legislative trends and their impact upon division work programs after a period of training. Ability to comprehend, analyze, interpret, and evaluate existing laws and proposed legislation and apply them to specific operating programs. Ability to develop and recommend changes to the public law to improve the effectiveness of enforcement programs of the division. Ability to delegate appropriate assignments and provide instruction and supervision to subordinates. Ability to interpret and disseminate technical regulations and determine their applications to the varied employer/employee situations that arise. Ability to direct the preparation of interpretative regulations, booklets, and other factual materials. Ability to develop an effective educational program for industry designed to facilitate the understanding and acceptance of the need for planned preventative programs in public safety, and of wage and hour enforcement practices. Ability to establish and maintain cooperative working agreements and relationships with departmental staff and representatives of other public and private agencies to achieve established objectives. Ability to address lay and professional groups on the work programs of the division. Ability to direct preparation of complex, detailed analyses and reports containing findings, conclusions, and recommendations. Ability to draft extensive correspondence. Ability to direct the establishment and maintenance of essential records and files. Ability to learn to utilize various types of electronic and/or manual recording and information systems used by the agency, office, or related units. Ability to read, write, speak, understand, or communicate in English sufficiently to perform the duties of this position. Note

Applicants must meet one of the following or a combination of both experience and education. Thirty (30) semester hour credits are equal to one (1) year of relevant experience. Ten (10) years of professional experience in the administration of a comprehensive public safety and/or workplace standards and enforcement program, three (3) years of which shall have been in a supervisory capacity. OR Possession of a bachelor's degree from an accredited college or university; and six (6) years of the above-mentioned professional experience, three (3) years of which shall have been in a supervisory capacity. "Professional experience" refers to work that is creative, analytical, evaluative, and interpretive; requires a range and depth of specialized knowledge of the profession's principles, concepts, theories, and practices; and is performed with the authority to act according to one's own judgment and make accurate and informed decisions.
