Definition
Under general guidance of the Director, Office of UI-DI Finance, this single incumbency title acts as a liaison between the division and the department's Office of Regulatory Services in receiving, formulating, and transmitting requests for legal advice on behalf of the agency; on behalf of the Director, signs judgments, certificates of debt, warrants of satisfaction, writs of execution, releases of liens, proofs of claims, and waivers of statute of limitations as per enabling legislation for the replaced title; does related work as required.
Examples of work
- Recommends to the Director when requests for legal advice from the Attorney General's Office are necessary or appropriate.
- In consultation with the Office of Regulatory Services, provides guidance as to the nature and substance of the various statutes and regulations covering the responsibilities of the division.
- Works with the department's Office of Regulatory Services and Office of Legislative Liaison to assist in drafting proposed regulations, legislation, and amendments in accord with the policy objectives of the division subject to restrictions applicable to nonattorneys.
- Reviews settlement agreements recommended to the Director by the Chief Auditor and in appropriate cases the Attorney General's Office prior to submission to the Office of Administrative Law.
- Reviews proposed rule changes prepared by the Regulations Committee and provides advice and/or support to division management in consultation with the Office of Regulatory Services.
- Assists the Director's staff in preparation of proposed legislation in consultation with the Office of the Legislative Liaison; reviews for the Director comments and fiscal analysis prepared by other staff regarding proposed legislation.
- Signs on behalf of the Director judgments, certificates of debt, warrants of satisfaction, writs of execution, releases of liens, waivers of statute of limitations, and proofs of claims.
- On behalf of the Director serves as liaison with County Sheriffs' Offices for UI collection activities, and assists in collection activities which could include procedures for identification of assets subject to execution.
- Reviews informal audit redeterminations for the Director or Chief Auditor to determine that they are consistent with Department of Labor policy and past practice.
- Reviews penalty abatements where abatement requested exceeds $5,000, and makes recommendations concerning the amount to be abated.
- Reviews requests to enter into agreement with the division for access to tax information and data, particularly requests for access to wage reporting data base; drafts agreement as required.
- Reviews requests for tax data relative to confidentiality restrictions.
- Reviews bankruptcy cases in consultation with the Attorney General's Office to determine if liability exists to the department.
- Reviews cases being considered for referral for criminal prosecution and consults with appropriate personnel from the Attorney General's Office.
- Prepares correspondence in the course of official duties.
- Will be required to learn to utilize various types of electronic and/or manual recording and computerized information systems used by the agency, office, or related units.
Education
Graduation from an accredited law school with Juris Doctor (J.D.) or a Bachelor of Laws (L.L.B.) degree.
Experience
Seven (7) years of comprehensive professional and/or administrative experience, or a combination thereof, in the review of legislative and/or general unemployment, or disability insurance types of administrative appeals.
License
Appointees will be required to possess a driver's license valid in New Jersey only if the operation of a vehicle, rather than employee mobility, is necessary to perform the essential duties of the position.
Knowledge, skills and abilities
- Knowledge of federal laws relative to the programs of the department.
- Knowledge of the laws of New Jersey relating to the several program areas administered by the department.
- Knowledge of the techniques involved in reviewing proposed legislation and in evaluating its effects on the present operations of the department including necessary policy and procedural changes enacted.
- Ability to develop and implement a consistent policy in interpretation of the various legal matters of concern to the department.
- Ability to direct the work program of a professional hearings and review staff accustomed to acting as an appellate tribunal of last resort.
- Ability to engage in independent research and analysis of opinions, writings, and proposed legislation.
- Ability to prepare drafts of tentative legislation affecting the department.
- Ability to develop appropriate rules and regulations and statements of policy and procedures and to evaluate recommendations for changes thereto.
- Ability to work effectively with subordinates and the principal officials of the department and of other departments including the Attorney General's and Governor's Offices.
- Ability to direct the preparation of extensive correspondence.
- Ability to prepare reports and summaries based on data, information, and records maintained.
- Ability to direct the establishment and maintenance of essential records and files.
- Ability to learn to utilize various types of electronic and/or manual recording and information systems used by the agency, office, or related units.
- Ability to read, write, speak, understand, or communicate in English sufficiently to perform the duties of this position. American Sign Language or Braille may also be considered as acceptable forms of communication.
