Definition
Under the direction of a supervisory official in the Department of the Treasury and Department of Labor & Workforce Development, supervises the work programs of lower level Affirmative Action Specialists; develops and implements affirmative action plans; supervises a program of monitoring contractor's equal employment opportunity performance and construction trades training-provider performance; and administers a program of affirmative action technical assistance to contractors, unions and public agencies; does other related duties as required.
Examples of work
Plans, coordinates, directs, and supervises field and/or office activities of an assigned unit in accordance with the goals and objectives of the Division's affirmative action compliance and equal employment opportunity program. Assigns and reviews work of a staff of subordinate Affirmative Action Specialists. Develops procedures, directives, and guidelines to implement equal employment opportunity programs for contractors. Recommends affirmative action policy in procurement/service and construction contracts awarded by all governmental agencies in the State, in accordance with existing State Equal Employment Opportunity laws. Develops and assists in developing regulations and guidelines based on P.L. 1975 C. 127, for contractor guidance, development and implementation of procurement/ service and construction affirmative action programs. Assists in developing the basic design for affirmative action plans submitted by contractors and prescribes affirmative action provisions to be included in all public contracts. Supervises the work of subordinate Affirmative Action Specialists responsible for monitoring and evaluation of contractors' procurement/services and construction performance regarding utilization of minorities and women, and providers of outreach, recruitment and training for minority and female workers in the construction trades. Supervises the review of affirmative action plans submitted by contractors and recommends approval or disapproval based on prescribed standards; ensures timely notification to contractors and government agencies approvals. Maintains liaison with the Division on Civil Rights, the Office of Federal Contract Compliance and various construction labor organizations. Directs and supervises the investigation of alleged discrimination complaints. Supervises an audit program of State, county, and municipal public agencies to determine whether contracts are being awarded in conformance with affirmative action provisions established under P.L. 1975, c. 127. Oversees larger public agency reviews. Establishes and maintains contact with federal and state agencies, contractor's associations, unions, minority/women's business groups and associations, and other groups interested in equality in employment and career development opportunities among minority groups. Develops procedures to monitor contractors and reviews monitoring reports to evaluate contractor's performance; reports alleged violations of anti-discrimination laws without delay, and when appropriate, recommends termination or stoppage on construction projects or construction trades training programs. Supervises the conduct of comprehensive compliance reviews of statewide construction projects to ensure contractor's and subcontractor's compliance with contract affirmative action/equal employment provisions. Supervises the inspection of construction job sites and evaluation of the employment policies of contractors and subcontractors. As required, conducts on-site visits with the construction company to obtain a profile on which to base construction project status reports, draw conclusions and make recommendations regarding compliance status. Verifies the availability of outreach and training funds set aside by the public agency awarding the construction contract within the guidelines of the affirmative action regulations. Directs the coordination of activities with various public agencies responsible for implementing public works projects, including training and employment of minorities and women. Supervises the monitoring and evaluation of the personnel programs of procurement and service, and construction contractors, including personnel policies and procedures, employee development programs, recruitment and employment practices and union enrollment, including the auditing of payrolls for verification. Develops procedures for reviewing affirmative action plans, construction trades training programs and a system for notifying contractors and government agencies. Represents the Division on the evaluation committee responsible for reviewing, evaluating, and making funding recommendations on proposals for construction trades outreach, recruitment and training for minorities and women. Supervises the administration of a program of technical assistance and consultant services to contractors and governmental bodies in the development of procurement/service and construction affirmative action plans. Directs the training of staff in rules and regulations, program policy and operating procedures of the State equal employment opportunity program for public works contractors and construction trades training providers. Organizes, develops, and conducts training sessions and seminars on creation of affirmative action programs; provides instructional information to contractors and government agencies and others in contract compliance matters; disseminates information to create and maintain community awareness of available opportunities and assistance. Schedules, assigns, and evaluates procurement/service and construction compliance reviews; supervises investigations to collect facts relative to violations and recommends solutions. Approves or disapproves affirmative action plans submitted by procurement/service and construction contractors, according to prescribed guidelines. Testifies in formal hearings and/or court proceedings on the compliance performance of public works contractors. Conducts in-house informal hearings and negotiates settlements on affirmative action compliance disputes. Reviews good faith documentation submitted by construction contractors in response to noncompliance determinations and prescribes required follow-up action. Makes final determinations on investigative reports and evidence prepared in response to alleged affirmative action violations. As required, issues alert notices and/or violation notices to construction contractors who fail to document affirmative action good faith efforts or fail to attain prescribed minority employment goals. Promotes employment of minority and female graduates of construction trades training programs in public works projects. Works with community organizations, trade unions, public agency compliance officers, contractors, and employment associations, in furthering State objectives in equal employment opportunity. Supervises the work operations and/or functional programs and has responsibility for employee evaluations and for effectively recommending the hiring, firing, promoting, demoting and/or disciplining of employees. Writes proposals to secure training funds from government agencies, authorities, foundations, and other sources, for the implementation of the affirmative action program. Conducts research and analysis of equal employment opportunity and affirmative action in the construction trades, including federal and state legislation, as well as court decisions; recommends revisions to rules, procedures, and standards, as appropriate. Meets with representatives of the public, community groups, contractor associations and local, state, and federal government agencies to further the objectives of equal employment opportunity. Prepares comprehensive reports on a variety of affirmative action activities. Prepares correspondence. Supervises the maintenance of essential records and files. Will be required to learn how to utilize various types of electronic and/or manual recording and information systems used by the agency, office, or related units.
License
Appointees will be required to possess a driver's license valid in New Jersey only if the operation of a vehicle, rather than employee mobility, is necessary to perform the essential duties of the position.
Knowledge, skills and abilities
Knowledge of the Affirmative Action Regulations for procurement/service and construction contracts under P.L. 1975 c. 127. Knowledge of State and Federal laws enforcing equal employment opportunity. Knowledge of employment practices as they relate pertain to civil rights, equal employment opportunity or affirmative action. Knowledge of personnel administration as it relates to the service, construction and manufacturing industries, including recruitment, selection, classification, employee development and employee relations. Knowledge of the methods and techniques used to conduct investigations of alleged violations of equal employment opportunity and affirmative action. Knowledge of interviewing techniques and their application to special compliance investigations. Knowledge of the methods used to gather, assemble, and organize information and report findings of affirmative action/equal employment opportunity compliance investigations. Ability to supervise in-depth investigations of alleged violations of equal employment opportunity and affirmative action laws, under P.L. 1975 c. 127. Ability to assign and instruct staff and supervise their work performance. Ability to develop and implement affirmative action programs for public works contracts. Thirty (30) semester hour credits are equal to one (1) year of relevant experience. OR Possession of a bachelor's degree from an accredited college or university; and four (4) years of the above-mentioned professional experience, one (1) year of which shall have been in a supervisory capacity. "Professional experience" refers to work that is creative, analytical, evaluative, and interpretive; requires a range and depth of specialized knowledge of the profession's principles, concepts, theories, and practices; and is performed with the authority to act according to one's own judgment and make accurate and informed decisions.
