In plain language

One year of continuous permanent service, aggregating to a year immediately before the announced closing date, in a title the examination is open to. Aggregate service is calculated the same way seniority is under 4A:4-2.15. In local service the figure is three years for promotion out of an entry level law enforcement or firefighter title, except as a law provides otherwise. You also have to be serving in the announced unit scope in a covered title, meet everything else in the announcement, and have avoided a Performance Assessment Review final rating below Successful, or the equivalent under an approved local evaluation program, in each of the two rating periods before the closing date. Out-of-title work generally cannot be used to qualify or to earn credit, though the Chairperson or designee may permit it for good cause, one stated example being where too few eligible employees would produce an incomplete list. Layoff gets specific treatment: eligibility established before a layoff takes effect survives it, and employees who return to a covered title and unit scope between the filing deadline and the examination date may still file.

Are you eligible for the promotional examination

Four things have to be true by the announced closing date, and all four, not three. One year of continuous permanent service, for an aggregate of one year immediately preceding that date, in a title the examination is open to. Currently serving in the announced unit scope in such a title, and meeting everything else in the announcement. No Performance Assessment Review final rating below Successful, or the local equivalent, in each of the two rating periods immediately preceding the closing date. And an application submitted on or before the announced filing date.

Local service adds a longer wait for uniformed staff: applicants promoting out of an entry level law enforcement or firefighter title need three years of continuous permanent service in a title the examination is open to, except where a statute says otherwise.

The performance criterion is the one that behaves differently by service. In State service the Performance Assessment Review covers all career service employees, running on standardised annual cycles with interim and final ratings six months apart, and the final rating on file at the closing date also earns examination credit, three points for Exceptional down to one for Successful. Where no final rating is on file at the closing date, the period is deemed Successful and credit is given for it. In local service there is no mandatory equivalent: an appointing authority may establish an evaluation program, and it can only be used in promotions or layoff if the Chairperson has approved it.

Out-of-title work is the trap. Where a promotional examination carries open competitive requirements, experience gained through out-of-title work may not be used to get into the examination or to earn credit in it, except where the Chairperson allows it for good cause. The stated example of good cause is narrow and turns on numbers rather than fairness: where the eligible pool would produce an incomplete list, or where applications exceed the provisional incumbents by no more than one, you may submit a detailed statement from your supervisor describing the duties and why they had to be performed, backed by a statement from the appointing authority verifying it and confirming interest in appointing from the resulting list. Doing the work is not the qualifying fact. Getting two people to write it down is.

Whether the examination is open to you at all is decided before any of this, by the title scope in the announcement, and the scope rules differ by service. In local service a promotional examination in a title series opens to the next lower in-series title, the next two lower, or those plus everyone in the unit scope meeting the open competitive requirements; where the title is not part of a series it opens to all applicants with a total of one year of permanent service who meet those requirements. In State service titles are sorted into professional, para-professional and non-professional categories, and the scope depends on whether the promotion moves within a category or between them, with bridge titles used for crossings. If an announcement is amended, every requirement still has to be met by the announced closing date, whether or not the filing date moves.

Four provisions cut the other way and are easy to miss. An employee who established eligibility for an examination with a closing date earlier than the effective date of a layoff is permitted to sit it. Employees separated or displaced by a layoff who return to a covered title and unit scope between the filing deadline and the examination date are allowed to file. Employees who took a voluntary demotion or came off a special reemployment list may count continuous permanent service in any higher related or comparable title toward the one-year requirement, and the uniformed equivalent applies to entry level law enforcement and firefighter titles. And the appointing authority may ask for the service requirement to be cut to completion of the working test period where the list would be incomplete, where vacancies will outnumber the possible eligibles, or for other valid reasons the Chairperson accepts. (a) Applicants for promotional examinations shall meet all of the following criteria by the announced closing date: #

1. Have one year of continuous permanent service for an aggregate of one year immediately preceding the closing date in a title or titles to which the examination is open. Aggregate service shall be calculated in the same manner as seniority as set forth in N.J.A.C. 4A:4-2.15; #

2. Be currently serving in the announced unit scope in a title to which the examination is open and meet all other requirements contained in the announcement. If an examination announcement is amended, all requirements must be met by the announced closing date whether or not the application filing date is changed; #

3. Have not received a Performance Assessment Review (PAR) final rating below the Successful level (or equivalent in an approved local service evaluation program) in each of the two rating periods immediately preceding the announced closing date; and #

4. Submit an application on or before the announced application filing date. #

(b) In local service, applicants for promotion from entry level law enforcement or firefighter titles shall have three years of continuous permanent service in a title to which the examination is open, except as otherwise provided by law. #

(c) Except when permitted by the Chairperson or designee for good cause, applicants for promotional examinations with open competitive requirements may not use experience gained as a result of out-of-title work to satisfy the requirements for admittance to the examination or for credit in the examination process. Good cause may include, but not be limited to, the following: #

1. Where the number of employees eligible for examination will result in an incomplete list, or where the number of applications does not exceed the number of provisional incumbents by more than one, the applicant may submit a detailed statement from his or her supervisor describing the out-of-title duties performed and the reasons why it was necessary to perform such duties. A statement shall also be submitted from the appointing authority verifying the supervisor's statement and indicating interest in making an appointment from the resultant eligible list. #

(d) Employees, with the exception of those serving in an entry level law enforcement or firefighter title, who have accepted a voluntary demotion to or are appointed from a special reemployment list to a title to which the examination is open, may, in order to satisfy the requirement of (a)1 above, include continuous permanent service in any higher related or comparable title. Employees serving in an entry level law enforcement or firefighter title who have accepted a voluntary demotion to or are appointed from a special reemployment list to a title to which the examination is open, may, in order to satisfy the requirement of (b) above, include continuous permanent service in any higher related or comparable uniformed title. #

(e) An employee who has established eligibility for a promotional examination with a closing date earlier than the effective date of a layoff shall be permitted to take such examination. #

(f) Employees who are separated or displaced as a result of a layoff and who subsequently return to a title and unit scope to which a promotional examination is open between the filing deadline and the examination date, shall be allowed to file for the examination. #

(g) An appointing authority may request that the time requirements specified in (a) and (b) above be reduced to completion of the working test period if: #

1. There is currently an incomplete promotional list and/or the number of employees eligible for examination will result in an incomplete list; #

2. It appears that vacancies to be filled within the duration of the promotional list will exceed the maximum number of eligibles that could result from examination; or #

3. Other valid reasons as determined by the Chairperson or designee. #

A fire captain challenged a colleague's promotion to deputy chief when the colleague had been about six weeks short of the year in grade the rules demand. The Appellate Division let the waiver stand, since the Commission may relax its own rules for good cause and the city had settled the colleague's claim that it had wrongly passed him over earlier. What the court would not let stand was the rest of that settlement: the city had privately promised the colleague the promotion if he came first on the examination, which strips the appointing authority of the choice the Rule of Three exists to give it. The promise was cut out of the deal and the selection ordered run again.
