Arrive late and whether you get in depends on what kind of test it is. For written or computer-based examinations, and examinations containing written and performance parts, a candidate who reaches the test room within 15 minutes of the designated time is admitted, unless the examination notice says otherwise. For oral examinations, and those containing oral and performance parts, the window is 30 minutes, and it closes the moment the last scheduled candidate has started. A candidate admitted late still receives the full allotted time to finish. The rest of the section is logistics: examinations may be scheduled for one or more sessions on a Statewide, regional or local basis, candidates are notified in an appropriate manner of time, place and any postponement or cancellation, and jurisdictions operating under Title 11A must furnish sufficient facilities when the Chairperson or designee asks for them.

(a) Examinations may be scheduled for one or more sessions on a Statewide, regional or local basis. #

(b) Candidates will be notified in an appropriate manner of the time and place of the examination, and of any postponement or cancellation. #

(c) Candidates shall be at the examination site at the designated time. Candidates arriving late shall only be admitted as follows: #

1. Unless the examination notice states otherwise, candidates for written or computer-based examinations or examinations containing written and performance parts shall be admitted to the examination if they arrive at the test room within 15 minutes after the designated time. #

2. Candidates for oral examinations or examinations containing oral and performance parts shall be admitted to the examination if they arrive at the test room within 30 minutes after the designated time, provided the last scheduled candidate has not started the examination. #

(d) A candidate who arrives late and is admitted to the examination shall receive the full allotted time to complete the examination. #

(e) Jurisdictions operating under Title 11A, New Jersey Statutes, shall furnish sufficient facilities for the conduct of examinations when requested by the Chairperson or designee. #

O'Malley v. Department of Energy109 N.J. 309, November 2, 1987

An engineer held a provisional appointment as a supervising energy specialist for about three years while the State never scheduled the examination that would have made it permanent, and was then sent back to his lower permanent title at roughly six thousand dollars less a year. The Supreme Court held he had no right to stay in the higher job and no right to a hearing about leaving it, and that the missing examination did not stop the agency from taking the position back, because nobody had misled him about what a provisional appointment was. A provisional appointment buys the higher salary for as long as it lasts and nothing further, no matter how long the delay drags on.
