Definition

Under direction of supervisory staff in the Department of Human Services, is responsible for organizing, preparing, and administering policies, procedures, and staffing operation including supervision of the inspection, evaluation, licensing of, and enforcement against child care centers, family day care homes and agencies, children's residential, shelter, and group care homes and facilities, child adoption agencies, and other regulated facilities/agencies; does other related duties as required.

Renders decisions of a substantive nature on a case-by-case basis in complex situations that impact child development, protection, and safety involving licensing and regulation of and enforcement against regulated facilities/agencies to regulate those facilities/agencies effectively, and makes determinations on denial, suspension, and revocation of licenses based on assessment of licensing violations and compliance histories. Approves referral of enforcement matters to the Office of the Attorney General to ensure compliance with state laws and regulations governing licensing or certification of regulated facilities/agencies to protect the health, safety, well-being, and development of children served. Provides knowledge, expertise, and technical assistance to supervisory staff in preparation of new legislation and amendment or repeal of existing legislation affecting licensing constituencies and the children and families they serve; reviews and analyzes proposed legislation to determine its impact on the department's licensing and enforcement activities and responsibilities and makes comments thereon. Supervises the conducting of Criminal History Record Information (CHRI) and Child Abuse Record Information (CARI) background checks on prospective adoptive parents and on staff members and other persons in regulated facilities/agencies to screen unsuitable individuals from adoption or from employment in children's programs; reviews and evaluates criminal conviction records and records of child abuse/neglect in keeping with provisions of applicable laws and regulations. Makes complex, difficult, and sensitive determinations on results of CHRI and CARI background checks that affect children's safety and welfare, employment of current and prospective staff members in regulated facilities/agencies, and ability of individuals to qualify to adopt children. Prepares and supervises the development and revision of Manuals of Requirements specifying regulations governing regulated facilities/agencies, and ensures that regulations safeguard, protect, and meet children's developmental and treatment needs without imposing unaffordable costs on regulated programs and services. Prepares and supervises development of social and economic impact analyses of new and revised regulations and transmits regulatory materials to the Office of Administrative Law for proposal and adoption in the New Jersey Register in keeping with the Administrative Procedure Act and applicable Executive Orders. Coordinates a comprehensive community participation process for development and revision of regulations governing regulated facilities/agencies including convening Citizens Ad Hoc Advisory Committees composed of professional experts in the field and representatives of all segments of the regulated community, conducting presentations at meetings and conferences of constituent organizations, and holding public hearings to provide information to and solicit input from the public subject to or affected by the regulations. Prepares written evidence and testimony for use at administrative hearings held because of noncompliance with or challenges to state licensing law and regulations, appears as an expert witness and represents the department at administrative hearings, court proceedings, and local municipal board proceedings related to regulated facilities/agencies, and prepares cases for the Office of the Attorney General for litigation or challenge concerning division decisions. Mediates disputes between regulated facilities and local governing bodies including zoning boards, code enforcement officials, and law enforcement agencies to ensure compliance with applicable laws, regulations, and building, fire, and health codes, and negotiates settlements and resolves conflicts of a critical, complex nature on licensing and regulatory issues involving regulated facilities/agencies. Prepares reports and correspondence on complex, sensitive regulatory issues and other aspects of the department's operation including Deputy Commissioner and Commissioner reports and correspondence for department supervisory staff. Prepares and supervises preparation of comprehensive informational materials designed to assist facilities and agencies subject to licensure or certification in complying with relevant licensing or certification laws, regulations, and standards. Prepares salary cost projections, workload formulas and determinations, staffing projections, and resource needs analyses to help formulate or revise the department's complex operations budget. Develops, proposes, and implements new and improved policies and procedures including both manual and automated systems for the operation of the department's units, and orients staff to changes in procedure and policy to ensure that department's goals and objectives are met effectively. Assigns, instructs, and directs supervisory, professional, and clerical staff in the management of materials, information, and protocols regarding applications for licensure, evaluation of regulated facilities' compliance with applicable law and regulations, investigation of complaints of violations of licensing regulations, and suppression of illegal operations by facilities and agencies subject to regulation by the department; oversees the accuracy, consistency, and quality of independent work conducted by field staff who inspect and conduct investigations of regulated facilities. Supervises, develops, implements, and manages manual and automated records, files, and information systems designed to ensure effective operation of the department including the Child Care Information and Retrieval Program (CHIRP) data base and related data bases using FoxPro, PC File, Microsoft Word, Microsoft Excel, Microsoft Access, and other software applications. Supervises the preparation of responses to inquiries from the public-at-large and from members of the state's child care and human services constituencies on matters involving department activities and responsibilities to promote public understanding of department policies and operations and to establish and maintain effective cooperative working relationships with these constituencies; handles complex, sensitive inquiries and inquiries from legislators, other state agencies, members of the press, and human services constituencies. Supervises research and preparation of monthly, annual, and other status reports on the department's progress and activities. Reviews, interprets, and summarizes technical, psychological, and educational literature relative to childcare, development, and safety, and explains such material to subordinates. Develops and implements innovative programs to provide new, improved services to regulated facilities/ agencies, and conducts training and orientation for department staff and staff of facilities/agencies licensed by or under contract with the department to ensure implementation of new services and procedures. Supervises, coordinates, and monitors work of supervisors to ensure that facilities/agencies are meeting developmental, and treatment needs of children, and are compliant with applicable state laws and regulations. Manages work operations and/or functional programs and has responsibility for employee evaluations and for effectively recommending the hiring, firing, promoting, demoting, and/or disciplining of employees. Addresses forums, seminars, conferences, and meetings designed to communicate and explain department policies, programs, and procedures and state licensing laws and regulations to New Jersey's childcare constituency and the public-at-large. Develops and maintains cooperative working relationships with federal, state, and local agencies as well as private organizations and individuals concerned with the health, safety, development, and well-being of children serviced by regulated facilities/agencies. Directs staff in investigation of complaints made against regulated facilities/agencies to ensure compliance with applicable state law and regulations, and handles complaints of a complex, unusual, or immediate nature that impact the safety and welfare of children, employment of staff members in and continued operation of these facilities/agencies. Conducts research on complex licensing and regulatory issues from state and national perspectives to ensure that department policies, procedures, and operations maintain state-of-the art integrity in human services regulatory administration. Provides knowledge and expertise in the preparation of Requests for Proposals and review and selection of bids for contracted services to children and to facilities and agencies serving children and families. Will be required to learn how to utilize various types of electronic and/or manual recording and information systems used by the agency, office, or related units.

License

Appointee will be required to possess a driver's license valid in New Jersey only if the operation of a vehicle, rather than employee mobility, is necessary to perform the essential duties of the position.

Knowledge, skills and abilities

Knowledge of processes and procedures used in inspection, evaluation, enforcement, and certification of childcare facilities/agencies including building safety and the well-being and development of children. Knowledge of childcare and residential programs and adoption agencies to determine their compliance with construction, programmatic, facility, and personnel requirements of state and federal laws and regulations. Knowledge of laws, rules, standards, and regulations established pursuant to the State Child Care Licensing Law, Family Day Care Provider Registration Act, State Adoption Law, State Juvenile Code Act, and appropriate state child welfare and child protection statutes. Knowledge of building, construction, and sanitation codes and state and federal laws and regulations affecting childcare and child welfare programs including knowledge of the New Jersey Uniform Construction Code (NJUCC) and Uniform Fire Code (NJUFC) as they pertain to regulated facilities/agencies. Nine (9) years of professional experience in in developing, planning, administering, inspecting, evaluating, regulating, or licensing programs, facilities, or providers associated with child care centers, infant and toddler programs, school-age child care programs, child care programs for mildly ill children, family day care sponsoring organizations, family day care homes, residential treatment centers, programs for pregnant and parenting adolescents, children's residential wilderness adventure programs, juvenile sex offender programs, children's shelters and shelter homes, children's group homes, supervised transitional living homes, treatment homes, teaching family homes, or adoption agencies, three (3) years of which shall have been in a supervisory capacity. OR: Possession of a bachelor's degree from an accredited college of university; and five (5) years of the above-mentioned professional experience, three (3) years of which shall have been in a supervisory capacity. OR: Possession of a master's degree Public or Business Administration, Law, Social Services, Public Health, Architecture, Engineering, Early Childhood Education, Education, Sociology, Psychology, Child Development, or related field from an accredited college or university; and four (4) years of the above-mentioned professional experience, three (3) years of which shall have been in a supervisory capacity. "Professional experience" refers to work that is creative, analytical, evaluative, and interpretive; requires a range and depth of specialized knowledge of the profession's principles, concepts, theories, and practices; and is performed with the authority to act according to one's own judgment and make accurate and informed decisions.
