Definition
Under the direction of the Chairman and in conformance with the Commission's Rules and the Procedure Act, presides at difficult and complex formal hearings and, with complete prepares written decisions containing detailed findings of fact, conclusions of law, and appropriate recommendations for service on the parties to the proceedings in cases involving alleged violations of the Act and disputes as to whether matters are within the scope of collective negotiations. Also serves as hearing officer in complex representation cases, objections cases, and cases in which challenged ballots are determinative of the results of election.

- Controls the calendar of formal hearings of cases assigned.
- Answers inquiries by litigants and their counsel concerning cases.
- Presides as hearing examiner in scope of negotiations proceedings arising under the provisions of the New Jersey Employer-Employee Relations Act.
- Sits as hearing examiner in unfair practice proceedings arising under the provisions of the New Jersey Employer-Employee Relations Act.
- Develops full and complete records of all relevant and material facts necessary for a fair and proper determination of the issues in complex representation proceedings.
- Conducts hearings in a fashion consistent with the requirements of procedural due process.
- Makes credibility determinations based upon. demeanor and bearing of witnesses in formal hearings.
- Rules on all motions including motions to dismiss complaints.
- Rules on admissibility of evidence.
- Assists litigants in the settlement of difficult and complex issues consistent with legislative and Commission policy.
- Prepares reports containing, statements of the case, findings of fact, conclusions of law, full statement and discussion of evidence and prepares recommended orders.
- <b>REQUIREMENTS
- EDUCATION</b>
- Graduation from an accredited school of law or the attainment of a Master's degree in industrial or labor relations or related field.
Experience
For attorneys, four years of labor relations experience including experience trying or hearing cases before administrative agencies or, for non-attorneys, at least six years of experience with administrative agencies with responsibility for hearing labor relations cases.
Knowledge, skills and abilities
- Through knowledge of courtroom procedures and conduct of administrative hearings
- Thorough knowledge of the Administrate Procedure Act. and the New Jersey Employer-Employee Relations Act.
- Complete understanding of and familiarity with. case law in other State and Federal jurisdictions involving unfair practices, scope of negotiations, remedies, and negotiations unit determinations.
- Ability to conduct conferences involving adverse parties having specialized knowledge and experience in the field.
- Ability to hear and decide exceedingly complex and significant cases involving alleged violations of the Act and the subject matter of collective negotiations.
- Ability to assist parties in informal resolutions and settlements of cases assigned.
- Ability to prepare detailed reports and decisions in. all cases, which must be able to stand on their own merit under the scrutiny of the Commission and the courts.
- Ability to as sole trier of fact in the first instance, with responsibility, sometimes in cases of first impression, to analyze issues and to recommend appropriate remedies consistent with legislative, judicial, and Commission policies.
