BackgroundThe appeal of Lauren Kropilak, Public Safety Telecommunicator, Gloucester County, Department of Emergency Response, of her five working day suspension (12-hour shirts), on charges, was heard by Administrative Law Judge Carl V. Buck, III (ALJ), who rendered his initial decision on March 16, 2022. No exceptions were filed.
AnalysisHaving considered the record and the ALJ’s initial decision, and having made an independent evaluation of the record, the Civil Service Commission, at its meeting of April 27, 2022, accepted and adopted the Findings of Fact and Conclusion as contained in the attached ALJ’s initial decision.
Since the suspension has been modified, the appellant is entitled to four working days (12-hour shifts) of back pay, benefits, and seniority pursuant to N.d_A.C. 4A:2-2.10.
ORDER
The Civil Service Commission finds that the action of the appointing authority in disciplining the appellant was justified. The Commission therefore modifies the five working day suspension (12-hour shifts) to a one working day suspension (12-hour shift). The Commission further orders that the appellant be granted back pay, benefits, and seniority of four working days (12-hour shifts). Proof of income earned shall be submitted by or on behalf of the appellant to the appointing authority within 30 days of issuance of this decision.
ClosingThis is the final administrative determination in this matter. Any further review should be pursued in a judicial forum.
