Action recorded in the minutes: The Civil Service Commission rejected the recommendation of the Administrative Law Judge and upheld the removals.

The decision

BackgroundThe appeals of A.E., a Human Services Technician, and H.D., a Human Services Assistant, with Trenton Psychiatric Hospital, Department of Health, of their removals, effective January 14, 2022, on charges, were heard by Administrative Law Judge Kimberley M. Wilson (ALJ), who rendered her initial decision on August 25, 2025. Exceptions were filed on behalf of the appointing authority, and a reply was filed on behalf of the appellants.

AnalysisHaving considered the record and the attached ALJ’s initial decision, including the finding of abuse sustained by the Office of Program Integrity and Accountability, Department of Human Services, and having made an independent evaluation of the record, the Civil Service Commission, at its meeting of February 4, 2026, rejected the Findings of Fact and Conclusions as contained in the ALJ’s initial decision to reverse the removals. This matter was a joint case with the Office of Program Integrity and Accountability, Department of Human Services. That office has the predominant interest and found in its attached decision that the appellants committed abuse. The Commission is bound by that finding, which also placed the appellants on the Central Registry of Offenders against Individuals with Developmental Disabilities. Therefore, the Commission upholds the removals of A.E. and H.D.

ORDER

The Civil Service Commission finds that the action of the appointing authority in removing the appellants was justified. The Commission therefore affirms that action and dismisses the appeals of A.E. and H.D.

ClosingThis is the final administrative determination in this matter. Any further review should be pursued in a judicial forum.
