Action recorded in the minutes: The Civil Service Commission affirmed the recommendation of the Administrative Law Judge.
The decision
BackgroundThe appeal of Darvel Davis, a Custodian with the Newark Public School District, of his removal, effective February 26, 2024, on charges, was heard by Administrative Law Judge Kelly J. Kirk (ALJ), who rendered her initial decision on May 7, 2026. No exceptions were filed.
AnalysisHaving considered the record and the attached ALJ’s initial decision, and having made an independent evaluation of the record, the Civil Service Commission (Commission), at its meeting on June 10, 2026, adopted the ALJ’s Findings of Fact and Conclusions of Law and her recommendation to uphold the appellant’s removal.
ORDER
The Civil Service Commission finds that action of the appointing authority in removing the appellant was justified. The Commission, therefore, affirms that action and dismisses the appeal of Darvel Davis.
ClosingThis is the final administrative determination in this matter. Any further review should be pursued in a judicial forum.
