CSC published this decision as a scanned image. The text below was recognized by OCR, read twice and checked against the meeting minutes, but OCR can misread a word. The official document is the record.
BackgroundThe appeal of Dylan Ralston, a Traffic Maintenance Worker,! with Atlantic County, Department of Public Works, of his release at the end of the working test period, effective April 1, 2025, was heard by Administrative Law Judge Susan McCabe (ALJ), who rendered her initial decision on March 25, 2026. No exceptions were filed.
AnalysisHaving considered the record and the attached ALJ’s initial decision, and having made an independent evaluation of the record, the Civil Service Commission, at its meeting on April 29, 2026, adopted the ALJ’s Findings of Fact and Conclusions of Law and her recommendation to uphold the appellant’s release at the end of the working test period. The Commission, therefore, does not find that the appointing authority acted in bad faith in releasing the appellant. See N.J.A.C. 4A:2-4.3(c). Accordingly, the appellant has not met his burden of proof in this matter. See N.J.A.C. 4A:2-4.3(b).
ORDER
The Civil Service Commission finds that action of the appointing authority in releasing the appellant at the end of the working test period was justified. The Commission, therefore, affirms that action and dismisses the appeal of Dylan Ralston.
ClosingThis is the final administrative determination in this matter. Any further review should be pursued in a judicial forum.
1 Agency records and the documents in the hearing record confirm that the appellant’s title is Traffic Maintenance Worker and not Laborer 1.
