Definition
Under the direction of a supervisory official in a state department, institution, or agency, supervises the review of applications for registration and Public Offering Statements in accordance with the Planned Real Estate Full Disclosure Act and Regulations (N.J.S.A. 45:22A-21 et seq.; N.J.A.C. 5:26-1.1 et seq.), or the New Jersey Real Estate Full Disclosure Act (N.J.S.A. 45:15-16.27 et seq.; N.J.A.C. 11:5-6.1 et seq.); does related work as required.
Examples of work
Supervises the daily work activities of subordinate staff in their review of Public Offering Statements and Applications for Registration for compliance with the Planned Real Estate Development Full Disclosure Act and Regulations or the New Jersey Real Estate Full Disclosure Act. Responds to all complaints and inquiries regarding Applications for Registered planned real estate developments or registered subdivisions. Provides recommendations regarding, and/or initiates legal action including, the assessment of penalties, issuance of Cease and Desist Orders, and revocations of registrations as deemed appropriate to penalize violators. Expedites the processing of Applications for Registration to ensure compliance with the statutory 90 day review period. Participates in, or directs meetings with developers and/or their legal representatives to review any problems which may exist in the Application, and suggests methods for correction. Makes recommendations for approval or rejection of Application for Registration. Supervises the work operations and/or functional programs, and has responsibility effectively recommending the hiring, firing, promoting, demoting and/or disciplining employees. Prepares correspondence relative to Applications for Registration and registered planned real estate developments or registered subdivisions. Supervises and/or conducts investigations of complaints in issues where compliance action is anticipated. Prepares monthly and yearly statistical reports covering the registered and condominium projects or subdivision projects. Assists in drafting amendments to the Planned Real Estate Full Disclosure and Regulations or the N.J. Real Estate Full Disclosure Act. Supervises the preparation of the Order of Registration for issuance when Application for Registration has been satisfactorily completed. Establishes and implements procedures for the processing of all funds received, whether fees or penalties. Will be required to learn to utilize various types of electronic and/or manual recording and information systems used by the agency, office, or related units.
License
Appointee will be required to possess a driver's license valid in New Jersey only if the operation of a vehicle, rather than employee mobility, is necessary to perform the essential duties of the position.
Knowledge, skills and abilities
Knowledge of real estate terms as they relate to the sale of residential properties. Knowledge of the types of title and related documents used in the sale of real estate. Knowledge of research methods and report writing. Knowledge of the methods used to research and brief court decisions, statutes, and other legal material. Ability to research, comprehend, interpret and apply New Jersey or other state corporate and partnership statutes. Ability to research comprehend, interpret and apply knowledge of the Penalty Enforcement Law (N.J.S.A. 2A-581 et seq.). Ability to research, comprehend, interpret and apply knowledge of the Planned Real Estate Full Disclosure Act of 1977, the Condominium Act and Retirement Full Disclosure Act of 1969 or the N.J. Real Estate Full Disclosure Act, N.J. Real Estate Licensing Law and the Interstate Land Sales Full Disclosure Act. Ability to establish and maintain cooperative working relationships with consumers, tenants, developers, and their representatives. Ability to comprehend, interpret, and apply contracts, agreements and site maps Ability to negotiate and resolve complex problems Ability to collect factual information from records and investigations and present it in understandable and accurate form Ability to establish and maintain an effective record-keeping system. Ability to conduct interviews with consumers, developers and attorneys Ability to comprehend and interpret basic laws, regulations, policies, standards and procedures and to apply them to specific situations in accordance with established guidelines Ability to prepare clear, sound, accurate, and informative reports containing findings, conclusions, and recommendations Ability to prepare correspondence in the course of official duties Ability to provide assignments and instructions to staff, and evaluate their work performance. Applicants must meet one of the following or a combination of both experience and education. Thirty (30) semester hour credits are equal to one (1) year of relevant experience. Nine (9) years of professional experience in the preparation, review and processing of legal documents relating to the development and sale of residential real estate and financial contracts and statements. OR Possession of a bachelor's degree from an accredited college or university; and five (5) years of the above-mentioned professional experience. OR Possession of an L.L.B. or J.D. degree from an accredited college or university; and two (2) years of the above-mentioned professional experience. "Professional experience" refers to work that is creative, analytical, evaluative, and interpretive; requires a range and depth of specialized knowledge of the profession's principles, concepts, theories, and practices; and is performed with the authority to act according to one's own judgment and make accurate and informed decisions.
