Examples of work
Provides training and instruction for the office and field staff in the proper conduct of office functions and investigations, inspections, and other work involved in the section. Plans, organizes, and assigns the work of the organizational unit and evaluates employee performance and conduct, enabling the effective recommendation of the hiring, firing, promoting, and disciplining of subordinates. Coordinates the work of the section with other units within the department and with outside agencies. Prepares extensive correspondence in the course of official duties. Supervises the conduct of inspections regarding laws administered by the Wage and Hour Division and Contract Compliance. Prepares and keeps current a manual of instructions and directives concerned with approved investigation and enforcement procedures; develops methods and procedures to be used in investigations. Holds informal conferences when alleged violations of the law and regulations administered by the Division occur; may authorize settlements pertaining to unpaid/underpaid wages, administrative fees and/or penalties. May conduct settlements concerning the confiscation of machinery and goods under the Apparel Registration Act. Supervises the preparation of cases referred for formal hearings before the Assistant Commissioner or Division Director. Is responsible for preparing information used in connection with complaints filed with the court for prosecution. Advises and guides employees on problems and interpretation of laws, administrative codes, and court procedures. As required, establishes and maintains cooperative work relationships with other state and federal agencies having an interest in the programs of the section, including the Department of Health, Law and Public Safety, Agriculture, Education, and Community Affairs. Works closely with agencies to meet common goals, reduce duplications, and cooperate on special emphasis programs. May be required to prepare accurate, detailed correspondence to contractors and subcontractors being debarred from public works in accordance with New Jersey Administrative Code; maintains current evidence, files, and listings of sustained debarments; notifies Departments of the Treasury and Transportation of contractors and subcontractors ineligible for public works and EDA assisted projects. Develops procedures for obtaining and maintaining sound and accurate statistical information. Analyzes computer statistical data to evaluate performance on the part of district supervisors and field staff; recommends courses of action to correct substandard performance. Analyzes field reports and recommendations of District Supervisor and directs which appropriate action is to be taken on violations. Attends and participates in staff conferences. Assists in problem solving for field staff. Receives, reviews, and drafts answers to correspondence concerned with alleged violations of the law administered by the agency and with complaints and other correspondence referred by the Chief or Assistant Director. May substitute for the Chief when necessary in the general administration of the agency. In cases of appeal to the Superior Court, reviews the opinions, findings-of-fact, and decisions for clarity and conformance to law, rule, regulation, and precedent; appears on behalf of the Office as expert witness or as a "Friend of the Court." In criminal cases, assists in preparing the case to be presented in court. Reviews and analyzes laws which have been passed by the state and federal government and decisions of the state and federal courts pertaining to the work of the unit, and makes proper use of these in the preparation of decisions. When required, presides at formal hearings, hears the evidence presented by both parties, and makes decisions based on evidence and in accordance with laws, regulations, precedents, policies, and procedures. Rules on application for adjournment or continuance, admissibility of evidence, and objections raised by counsel; takes steps to ensure that proper order and decorum is maintained within the hearing room. Prepares and oversees the preparation of clear, sound, accurate, and comprehensive statistical and other reports containing findings, conclusions, and recommendations. Oversees the establishment and maintenance of essential records and files. Will be required to learn how to utilize various types of electronic and/or manual recording and computerized information system used by the agency, office, or related units.
License
Appointees will be required to possess a driver's license valid in New Jersey only if the operation of a vehicle, rather than employee mobility, is necessary to perform the essential duties of the position.
Knowledge, skills and abilities
Knowledge of modern business practices, records, files, and books of account, and their content and interpretation. Knowledge of the procedures to be used in collecting, appraising, analyzing, and interpreting recorded facts and those given orally. Knowledge of the methods and procedures to be followed in holding formal hearings and in rendering decisions based on fact and evidence. Knowledge of the taking of testimony in such a manner as to preserve the legal rights of the parties involved and of the state. Knowledge of supervisory methods and techniques. Knowledge of the preparation of case records for use in hearings and court proceedings. Ability to interpret and apply the laws of New Jersey and the federal government concerning minimum wages and wage claims. Ability to interpret and apply federal and New Jersey laws, and the regulations, procedures, policies, and standards of the Department and cooperative departments and agencies relating to the health, welfare, and safety of seasonal agricultural works in New Jersey. Ability to interpret and apply federal and New Jersey laws, rules, and regulations relating to Child Labor, minimum wages, time and manner of payment, mercantile inspection, industrial homework, wage discrimination, and wage orders and regulations. Ability to interpret and apply the New Jersey Prevailing Wage Rate Act and the Fringe Benefit Law and related federal statutes, rules, and regulations. Ability to understand and apply enforcement procedures and problems involved in the work of the section and Division of Wage and Hour Compliance. Ability to develop, organize, install and, when required, revise office and field work routines and procedures. Ability to confer with trades councils, labor unions, collective bargaining agencies and with state, federal, and local government jurisdictions as well as other authorities, to secure needed information and to explain the provisions of the laws administered and enforced by the office. Ability to investigate or arrange for the investigation of complaints arising from alleged violations of the law or contractual agreements covered under the law. Ability to prepare written reports in detail based upon investigations. Ability to assist in preparing cases for prosecution. Ability to coordinate the work of the section with that of other units within the department. Ability to conduct informal hearings and prepare cases of alleged violations of various statutes under the jurisdiction of the office. Ability to supervise the collection, recording, and transfer of fines and penalties. Ability to understand and apply the regulations, policies, standards, and procedures of the Division. Ability to utilize the legal research tools available for research of court decisions. Ability to understand the proper form and content of field inspection reports and of applications for the varied permits issued by the Division. Ability to perform mathematical calculations as they may relate to wage issues or wage rate data. Ability to conduct hearings in the most efficient and effective manner in order to reach sound conclusions. Ability to plan and coordinate surveillance activities. Ability to communicate the work of the office to individual and groups. Ability to give suitable assignments and instructions to the field staff of the office, supervise, and evaluate the performance of their work. Ability to prepare correspondence relating to the work of the office. Ability to prepare statistical and other reports containing findings, conclusions, and recommendations. Ability to supervise the maintenance of essential records and files. Ability to organize assigned supervisory work and develop effective work methods. Ability to learn how to utilize various types of electronic and/or manual recording and information systems used by the agency, office, or related units. Ability to read, write, speak, understand, and communicate in English sufficiently to perform the duties of this position. Thirty (30) semester hour credits are equal to one (1) year of relevant experience. Nine (9) years of professional experience in a public or private agency identifying and investigating violations in a field of specific regulatory conditions, interpreting and applying these regulations and making recommendations based on findings, one (1) year of which shall have been in a supervisory capacity, or shall have involved the adjudication of wage disputes. OR Possession of a bachelor's degree from an accredited college or university; and five (5) years of the above-mentioned professional experience, one (1) year of which shall have been in a supervisory capacity, or shall have involved the adjudication of wage disputes. OR Possession of a master's degree in business or public administration; and four (4) years of the above-mentioned professional experience, one (1) year of which shall have been in a supervisory capacity, or shall have involved the adjudication of wage disputes. "Professional experience" refers to work that is creative, analytical, evaluative, and interpretive; requires a range and depth of specialized knowledge of the profession's principles, concepts, theories, and practices; and is performed with the authority to act according to one's own judgment and make accurate and informed decisions.
