The career service splits in two. One division is competitive, the other is not, and which division a title sits in is the Commission's decision. The Commission may also set up routes for an employee to move between the divisions, promotion included. What this section does not do is say when a title qualifies for the noncompetitive division. That question is answered in part by the findings the Legislature added at 11A:3-2.1, which describe the noncompetitive division as intended for jobs that cannot properly be tested for.
