N.J.S.A. 11A:6-19.1 Payment of accumulated sick leave by political subdivision under civil service

Notwithstanding any law, rule or regulation to the contrary, a political subdivision of the State, or an agency, authority or instrumentality thereof,…

Title 11A · Chapter 6. Employee Leaves, Work Hours, and Career Development · Article 1

In plain language

A $15,000 cap on the local sick-leave payout, and it reaches a much narrower group than it first appears. It applies to an "officer or employee" of a political subdivision under Title 11A, and the section defines that term restrictively: elected officials, gubernatorial appointees, and people appointed by an elected official or governing body with a specific consent process similar to Senate advice and consent. It EXPRESSLY EXCLUDES anyone employed or appointed in the regular course, and excludes by name the certified health officer, tax assessor, tax collector, municipal planner, chief financial officer, registered municipal clerk, construction code official, uniform subcode inspector, qualified purchasing agent and certified public works manager. Two savings clauses preserve amounts already accrued as of the 2007 act, or on the expiration of a contract then in force, whichever is greater.

Written by the NJ Civil Service Navigator editorial team from the text of this section. The statute itself is below, unabridged.

Current through the close of the 221st Legislature (L. 2025, c. 346). What that means

Enacted by L. 2007, c. 92, effective June 8, 2007. Never amended since.

A New Jersey statute changes only when the Legislature amends it, so a section untouched since its last amendment is settled rather than out of date.

Supplemental compensation shall be payable only at the time of retirement from a State-administered or locally-administered retirement system based on the leave credited on the date of retirement.
