In plain language

Three things count as major discipline: removal, disciplinary demotion, and a suspension or fine of more than five working days at one time. Anything smaller is minor discipline and runs on a different track under 4A:2-3, with different appeal rights, which makes this short section the fork in the road that decides everything downstream. One detail catches people out on the arithmetic. When a Final Notice of Disciplinary Action, a Commission decision or a settlement expresses a suspension in days, it means working days unless it says otherwise. A twenty-day suspension is four weeks of pay, not three.

(a) Major discipline shall include: #

1. Removal; #

2. Disciplinary demotion; and #

3. Suspension or fine for more than five working days at any one time. #

(b) See N.J.A.C. 4A:2-2.9 for minor disciplinary matters that are subject to a hearing, and N.J.A.C. 4A:2-3 for all other minor disciplinary matters. #

(c) The length of a suspension in a Final Notice of Disciplinary Action, a Commission decision, or a settlement, when expressed in "days," shall mean working days, unless otherwise stated. #

In re Stallworth208 N.J. 182, April 12, 2011

A public employee was fired over an unauthorised long break, and the Civil Service Commission cut the penalty to a four month suspension before the Appellate Division put the firing back. The Supreme Court held the Appellate Division had overstepped: reviewing courts owe the Commission deference on penalty, and they may not substitute their own weighing of an employee's prior record for the agency's. It sent the case back to the Commission rather than deciding the penalty itself, and it corrected the lower court on progressive discipline, which turns on the difference between major and minor prior sanctions rather than on a raw count of them.
