  • 4A:1-2.1Civil Service Commission access to appointing authority records and information

    Appointing authorities must let Civil Service Commission representatives onto their premises and hand over whatever records and information the Commission requests. The rule attaches no conditions to that. Nothing in it makes access depend on a complaint having been filed first, on an investigation having opened, or on the request being justified. The obligation runs in one direction only. What the Commission may then release from what it collects is a separate question, and 4A:1-2.2 answers it.

  • 4A:1-2.2Public records

    Salary is public. The personnel file behind it is not. This section draws that line across Civil Service Commission records. Public: an individual name, title, salary, compensation, dates of government service and reason for separation; the specific educational or medical qualifications a position requires; final orders of the Commission; and any other records the law requires to be made, maintained or kept on file. Not public: individual personnel records beyond those items, which are released only to the subject employee, an authorised representative of that employee, or governmental representatives in connection with their official duties. The medical category splits in two directions at once. What a job requires is disclosable. An individual medical, psychiatric or psychological history, diagnosis, treatment or evaluation is not.
