Whether a gap in service costs you your accumulated sick leave depends on why the gap happened. Separation due to layoff is protected: the employee is credited with sick leave accrued both before the separation and after returning. Any other kind of break is treated differently, on the terms the section sets out. Being laid off is not the employee's doing, and this is one of several places in the title where that distinction carries a concrete consequence.

An employee who has incurred or shall incur a break in service as a result of separation due to layoff shall be credited with sick leave accrued both before separation and after return to employment. An employee incurring a break in service for any other type of separation shall have sick leave computed only from the date of return to employment.
