Appealing an examination or selection decision

This section sorts rather than decides. Three destinations exist and picking the wrong one costs time you may not have. Appeals about examination items, scoring and administration go to one rule. Disqualification for medical or psychological reasons goes to another. Everything else examination related goes to a third, and that third category is broader than its name: it takes in the disqualifications for lacking job requirements, unfitness, disciplinary removal, false statements, adverse employment history and the rest, along with list extension or revival, and denial of veterans preference for a particular examination. Removal of a name from an eligible list is routed here too, by the removal rule itself.

The burden of proof splits once. In every category the appellant carries it, except in medical or psychological disqualification appeals, where the appointing authority carries it instead. That is the reverse of the general position across Commission appeals, where the appellant bears the burden in everything other than major discipline.

The deadline is not in this section, which is the practical trap in it. For the general examination related category it sits in the disqualification appeals rule: 20 days from notice of the action, decision or situation being appealed, filed with the Commission representative indicated on the notice advising of disqualification, not with whichever office seems most likely. Medical and psychological appeals have their own 20 days from notification, plus 90 calendar days from filing to get in a report from a physician, psychologist or psychiatrist of your own choosing. Item, scoring and administration appeals are the fast ones, measured in five business day windows, with an administration challenge due in writing at the examination site on the day. Where no period is stated anywhere, the general appeals rule supplies 20 days from notice or from when you should reasonably have known.

Filing changes nothing on the ground. Unless the Commission or the Chairperson orders otherwise, an appeal does not affect the promulgation of a list, a certification or an appointment, so the vacancy can be filled while the appeal is pending. The one structural answer to that is the conditional regular appointment, which an appointing authority may make in the competitive division where disputes or appeals about higher ranking eligibles could change the outcome. A conditional appointee stays on the list, and if the higher ranked eligible prevails the conditional appointment ends. A person appealing an examination disqualification may be admitted to the examination where appropriate, but the results are held unprocessed while the review runs.

Form matters here more than in most places. The appeal must be in writing and include the examination title and symbol number where relevant, the action being appealed, the specific objections and the relief requested, and every party has to serve copies of all materials on every other party.

One exclusion is worth reading twice. Non-selection for an advancement appointment is expressly outside the examination appeal procedures and belongs to the grievance route instead. The section governing those appointments is currently reserved, so the rule directs you away from an appeal that would not fit anyway, and toward the minor discipline and grievance subchapter, which in State service runs through departmental steps first and is subject to a threshold test of general applicability at the Commission. In local service that subchapter does not apply, and the appointing authority may establish its own grievance procedures.
