Definition
Under direction of a supervising official in the Department of Banking and Insurance (DOBI), is responsible for the work program and staff engaged in licensing and operations of organizations that are licensed or governed by the agency; does other related duties as required.
Examples of work
Develops, executes, and evaluates work plans, procedures, programs, and schedules for the processing, approving, issuing and mailing of initial and renewal licenses issued by the agency. Analyzes and reviews information obtained from accounting records of licenses and forwards to division investigation staff to establish facts with respect to possible violations of certain statutes. Conducts personal conferences and prepares extensive correspondence in response to inquiries from organizations and persons, or their attorneys, who are applying for or renewing licenses. Dispenses interpretive and technical advice on the licensing statutes, regulations and policies to senior management and other DOBI staff, licensees and prospective licensees, industry trade associations, attorneys, accountants, and the general public. Maintains ongoing relationships with industry groups to promote a partnership allowing for accessibility to information, programs under review, advisories and proposed changes affecting the regulated industries. Interviews applicants seeking to reinstate licenses which have been suspended, revoked or not renewed. Directs and trains subordinate staff through the formulation and modification of procedures, methods and strategies and conducts training sessions as may be required to ensure staff understanding of changes and the unit's mission. After review, gives final approval for initial and renewal licenses issued to organizations or persons. Supervises the approval process, issuance and mailing of initial and renewal licenses. Provides input in the establishment of new procedures or changes in procedures for data processing application to ensure efficient, effective and timely issuance of all licenses. Acts as liaison with national licensing databases and the management of same to coordinate all actions relating to the electronic submission of license applications by various types of DOBI license applicants; to advise of changes needed to be made relating to statutory and regulatory changes affecting licensing; to troubleshoot problems identified in the national databases' interface with DOBI staff and its licensees and license applicants. Determines under what circumstances a licensee is entitle to a refund of the license fee. Supervises all coding for the data processing of licenses using various computer software. Is responsible for establishment of procedures to safeguard and account for monies collected. Supervises work operations and/or programs and has responsibility for effectively recommending the hiring, firing, demoting and /or disciplining of employees. Coordinates preliminary hearings with licensees, nonlicensees and their attorneys to verify facts developed through investigation and field work. Prepares detailed information as required for reports containing findings, conclusions and recommendations. May contribute to the preparation of the annual budget. Observes compliance with State laws, rules and regulations promulgated pertaining to organizations and persons. Takes necessary action to obtain confidential reports from law enforcement agencies, court actions, and related material. Analyzes and makes changes in systems, forms and internal controls to carry out statutory responsibilities. Assists counsel in the preparation of cases for hearings or disciplinary actions to be taken by the Commissioner against licensees and nonlicensees subject to the agency's authority. Presents evidence, testifies under oath at hearings and acts as a witness in court proceedings in cases involving prosecutions for violations of statutes administered by the Department or any other matters to which the agency is a party. Participates in conferences with representatives of organizations under jurisdiction of the Department concerning proposed or pending legislation. Drafts or participates in drafting legislation recommended by the Department or proposed amendments to legislation which has been introduced to change present laws. Will be required to learn to utilize various types of electronic and/or manual recording and computerized information systems used by the agency, office or related units.
License
Appointees will be required to possess a driver's license valid in New Jersey only if the operation of a vehicle, rather than employee mobility, is necessary to perform the essential duties of the position.
Knowledge, skills and abilities
Knowledge of accounting principles, office methods and general financial procedures and their application. Knowledge of the techniques utilized in interviewing applicants. Ability to read and interpret laws, rules and regulations concerning the licensing and investigation of organizations and individuals under the supervision of the agency. Ability to take and maintain a firm, correct stand when differences of opinion or fact arise, or when irregularities are discovered. Ability to organize and execute plans for effective utilization of available funds, personnel, equipment and supplies. Ability to give appropriate assignments and instructions to investigative, clerical and other personnel and to supervise the performance of their work. Ability to read and interpret procedures involved in the issuance of initial or renewal of certain licenses issued by the agency. Ability to appraise significance of facts disclosed through new or renewal applications or results of investigations, and prepares detailed reports thereon containing findings, conclusions, and recommendations. Ability to account for monies received or refunds paid. Ability to conduct conferences or informal hearings and interact with applicants, licensees, nonlicensees, and attorneys representing these individuals or the public to provide them with advice, information and assistance. Ability to persuade licensees to voluntarily observe statutory requirements. Ability to draft extensive correspondence. Ability to comprehend relevant laws and regulations, to interpret them in non-legal language and to apply them in specific situations. Ability to recognize the need to revise systems, forms and internal operations. Ability to act as a witness at agency hearings or in court proceedings. Ability to utilize various types of electronic and/or manual recording and information systems used by the agency or related units. Ability to read, write, speak, understand and communicate in English sufficiently to perform the duties of this position. American Sign Language or Braille may also be considered as acceptable forms of communication. Thirty (30) semester hour credits are equal to one (1) year of relevant experience. Eight (8) years of professional experience in work involving the licensing, examination, evaluation, analysis, or investigation of individuals or organizations subject to licensure/regulation by DOBI, two (2) years of which shall have been in a supervisory capacity. OR Possession of a bachelor's degree from an accredited college or university; and four (4) years of the above-mentioned professional experience, two (2) years of which shall have been in a supervisory capacity. "Professional experience" refers to work that is creative, analytical, evaluative, and interpretive; requires a range and depth of specialized knowledge of the profession's principles, concepts, theories, and practices; and is performed with the authority to act according to one's own judgment and make accurate and informed decisions.
