Definition
Under the direction of a Manager in the Department of Transportation, performs and supervises the performance of research in connection with right of way acquisition and prepares or supervises the preparation of all documents pertaining thereto; does related work as required.
Examples of work
Prepares and/or supervises the preparation of all legal documents pertaining to the acquisition of real property by means of condemnation, such as: complaints, lis pendens, declaration of taking, order for payment into court and for possession, order for judgment and appointing commissioners. In cases where a complaint requires an amendment, prepares and/or supervises the preparation of notices of motion to amend the complaint or order to show cause why the complaints should not be amended, the amendment to the complaint, consent orders, amended declarations of takings, amended lis pendens, order allowing amendment of the complaint. In cases where settlement is reached by agreement, prepares and/or supervises the preparation of an affidavit for withdrawal of funds on deposit with the Clerk of Superior Court, together with an Order allowing the withdrawal; when required, draws warrants to discharge a lis pendens of record. Corresponds with attorneys and property owners when not represented by attorneys, in writing, discussion by telephone, or in person; supervises such correspondence. Effects liaison with the Title Bureau concerning title matters and with department engineers concerning engineering matters. Effects liaison with the Manager for coordination and documentation on delicate cases. Supervises the filing of legal documents with the court and with the County Clerk's office in the appropriate county. Supervises the transference of complete files to the Attorney General's office for trial in court. Supervises the preparation of copies of complaints and related documents for service upon all parties and interests named in the complaints, and the transmittal of copies to the Title Bureau for service by Process Servers. Works with the Office of the Attorney General in department legal matters as may be required and prepares and/or supervises the preparation of material for use in litigation in conjunction with the Office of the Attorney General. Gives appropriate assignments and instructions to subordinates and supervises the performance of their work. Supervises the preparation and filing of affidavits of service. Prepares and/or supervises the preparation of publications for location of owners to be advertised in newspapers; prepares and files and/or supervises the preparation and filing of affidavits of inquiry into location of unknown owners. Prepares and supervises the preparation of correspondence in the course of official duties. Prepares and supervises the preparation of clear, technically sound, accurate and informative reports. Supervises the maintenance of essential records, reports and files. Supervises work operations and/or functional programs, and has responsibility for employee evaluations and for effectively recommending the hiring, firing, promoting, demoting, and/or disciplining of employees. May be required to learn to utilize various types of electronic and/or manual recording and information systems used by the agency, office, or related units.
Education
Graduation from an accredited law school.
Experience
Five (5) years of experience in the preparation of documents pertaining to the acquisition of right of way, which shall have included study and experience in legal research.
Knowledge, skills and abilities
Knowledge of the practices and procedures of Right of Way acquisition. Knowledge of the sources, documents, methods, and procedures involved in the acquisition of real property by means of condemnation. Knowledge of the methods and procedures for filing documents with courts and county clerk's offices. Ability to organize and carry through research and related projects concerned with the acquisition of real property. Ability to comprehend, analyze, and interpret basic law, regulations, and procedures. Ability to assign, instruct and supervise the work of subordinate staff. Ability to locate and brief court decisions, precedents, opinions, legal citations, and other legal material. Ability to determine the compliance of department procedures with those established by courts of law. Ability to prepare and supervise the preparation of material for hearings, reviews, determinations, and use in court. Ability to establish and maintain liaison with department officers, fellow employees, with the public and public officials, and with the Office of the Attorney General. Ability to supervise the collection, interpretation, and presentation of information and data in an understandable and useful manner. Ability to draft and supervise the drafting of effective technical and non-technical correspondence. Ability to write and supervise the writing of reports of a high professional order containing findings and conclusions. Ability to prepare and supervise the preparation of clear, legally sound, accurate and informative reports containing findings, conclusions and recommendations. Ability to supervise the maintenance of essential records and files. Ability to learn to utilize various types of electronic and/or manual recording and information systems used by the agency, office, or related units. Ability to read, write, speak, understand, or communicate in English sufficiently to perform the duties of this position.
