A carve-out from the layoff chapter, with one thing carved back in. Where employees have their weekly hours reduced and receive short time compensation under an approved shared work programme, or where they participate in a furlough programme, Chapter 8 of Title 11A does not apply to them: the notice periods, the pre-layoff actions and the appeal rights are all switched off. The exception is seniority. Provisions concerning the seniority rights of a participant continue and may not be adversely affected by taking part, which is what stops a voluntary reduction from costing someone their place in a later layoff.

Notwithstanding the provisions of any other law or regulation to the contrary, the provisions of chapter 8 of Title 11A of the New Jersey Statutes shall not apply to employees who have their weekly hours of work reduced and receive short time compensation benefits under a shared work program approved pursuant to the provisions of P.L.2011, c.154 (C.43:21-20.3 et seq.) or who participate in a furlough program, except the provisions of Title 11A of the New Jersey Statutes concerning the seniority rights of an employee who participates in a shared work program or furlough program shall continue and shall not be adversely affected by participation in such programs.
