DETECTIVE 1 STATE INVESTIGATOR, LAW AND PUBLIC SAFETY

Definition

Under supervision in the Division of Criminal Justice, Department of Law and Public Safety, performs varied investigative functions involved with financial, compliance, and enforcement activities concerning criminal violations of state statutes; is authorized to exercise all powers and rights of police officers, constables, and special deputy sheriffs in criminal matters, and is empowered to act as officer for the detection, apprehension, arrest, and conviction of offenders against the law; do other related duties as required.

Examples of work

• Exercises all powers and rights of police officers, constables, and special deputy sheriffs in criminal matters, and functions as a law enforcement officer for the detection, apprehension, arrest, and prosecution of offenders against the law.
• Performs various financial, compliance, and enforcement investigations.
• Conducts assigned investigations relating to alleged or suspected violations of state law.
• Prepares affidavits and search warrants.
• Conducts surveillance designed to apprehend individuals engaged in criminal activity or to gather investigative information.
• Applies techniques such as protective surveys and assignments, surveillance, and undercover work.
• Investigates information on applications and other documents.
• Investigates allegations of negligence, incompetence, misrepresentation, or misconduct by individuals, organizations, vendors, service providers, or other agencies.
• Investigates fraud or misconduct.
• Investigates complaints received from the general public.
• May assist in training other detectives.
• Prepares and analyzes reports during the course of an investigation.
• Collects, secures and preserves evidence obtained from an investigation.
• Catalogs evidence for storage for presentation in court or administrative hearings.
• Develops and follows up leads or information for investigative purposes.
• Enforces compliance with appropriate standards, codes, laws, rules, or regulations.
• Enforces court orders and monitors compliance of order.
• Provides justification for requested subpoenas, citations, warrants or summonses.
• Questions and subpoenas witnesses, and provides for transportation and security of defendants and witnesses.
• Drafts affidavits.
• Obtains affidavits or sworn testimonies from complainants, witnesses, victims or principals involved in an investigation.
• Serves legal notices, subpoenas, and other documents.
• Presents information in a manner that meets requirements for legal hearings and court proceedings, or other legal matters.
• Obtains warrants for required inspections or administrative searches of premises.
• Interviews individuals to obtain confidential and comprehensive information.
• Writes investigative reports.
• Testifies before Grand Juries, Courts of Law, and other judicial or administrative bodies.
• Provides in and out of court assistance to Deputy Attorneys General during investigations and court proceedings.
• Analyzes evidence obtained for appropriateness and relevance.
• Files charges against alleged perpetrators based upon the evidence.
• Exercises power of arrest with discretion.
• Maintains records and files.
• Uses various types of electronic communications equipment, electronic surveillance equipment, photographic equipment, recording devices, and database software for investigative activities.
• Will be required to learn to utilize various types of electronic and/or manual recording and information systems used by the agency, office, or related units.

Education

Graduation from an accredited college or university with a Bachelor's degree.

Experience

Three (3) years of as a sworn law enforcement officer -or- successful completion of the Detective Trainee- State Investigator, Law and Public Safety program.

License

Appointee will be required to possess a driver's license valid in New Jersey only if the operation of a vehicle, rather than employee mobility, is necessary to perform essential duties of the position.

Knowledge, skills and abilities

• Knowledge of investigative techniques, methods and procedures including the continuous revision and alteration of these methods and procedures as may be required per investigation.
• Knowledge of principles of communications to achieve the results desired.
• Knowledge of Title 2C statues; including the New Jersey Court Rules and the New Jersey Rules of evidence.
• Knowledge of law enforcement operations and procedures on local, state, national, and international levels.
• Knowledge of corporation structures, financial transactions, and of financial fraud in large scale corporations leading to successful conclusion of audit reviews and investigations.
• Knowledge of surveillance methods and procedures.
• Knowledge of civil rights of individuals under investigation.
• Knowledge of surveillance devices and photographic and video equipment utilized during the course of an investigation.
• Knowledge of techniques of investigative reporting and the preparation of detailed investigative reports.
• Knowledge of procedures for conducting background checks.
• Knowledge of procedures governing the rules of evidence.
• Knowledge of electronic communications equipment and data base software utilized during the course of an investigation.
• Knowledge of the type of documents required for litigation and their preparation.
• Knowledge of methods and techniques of covert investigation.
• Knowledge of procedures for preparing affidavits or sworn testimonies obtained during the course of investigation.
• Knowledge of procedures for conducting background checks.
• Ability to learn latest technological advances used by criminals and investigators.
• Ability to exercise all powers and rights of police officer, constables, and special deputy sheriffs in criminal matters and to function as a law enforcement officer for the detection, apprehension, arrest, and prosecution of offenders against the law.
• Ability to learn and follow DCJ Standard Operating Procedures and Attorney General Directives and Guidelines.
• Ability to testify as a state witness in criminal, and civil investigations before State Grand Juries, Federal Court, other courts of law or other judicial or hearing forums.
• Ability to prepare and execute affidavits and search warrants to include preparation of returns on warrants to the court.
• Ability to utilize informants during the course of investigative activities.
• Ability to participate in and render assistance in training activities.
• Ability to prepare detailed correspondence during the course of investigation activities.
• Ability to show good judgment and case when exercising powers of arrest or detainment of alleged offenders.
• Ability to travel extensively during the performance of assigned duties.
• Ability to work under adverse conditions and at any hour of the day or night.
• Ability to effectively deal with witnesses, targets and other parties from diverse cultural and socio-economic backgrounds in typically adversarial situations.

• Ability to qualify with firearms on a semiannual basis.
• Ability to utilize various types of electronic and/or manual recording and information systems used by the agency, office, or related units.
• Ability to read, writes, speak, understand, and communicate in English sufficiently to perform the duties of this position. American Sign Language or Braille may also be considered as acceptable forms of communication.

Applicants who do not possess the required education may substitute additional experience as required on a year-for-year basis with thirty (30) semester hour credits being equal to one (1) year of experience.

A Master's degree or certification as a Certified Public Accountant may be substituted for one (1) year of indicated experience.

Applicants accepting employment are required to adhere to the employment restriction that they not pursue outside gainful employment during their tenure with the Division of Criminal Justice unless approved by the Attorney General.

<b> SPECIAL QUALIFICATIONS:</b>

Applicants must have successfully completed the police training commission course administered by the Police Training Commission. This training includes successful attainment of a required level of proficiency in the use of firearms.

Appointees to this position shall qualify semi-annually in the use of firearms.

Must be a citizen of the United States.

<b>MEDICAL EXAMINATION:</b>

As a prerequisite for appointment, appointees may be required to pass a thorough medical and psychiatric examination to be administered by the appointing authority. Any psychological, medical or physical condition or defect which would prevent efficient performance of the duties of the position, cause the appointee to be a hazard to himself/herself or others, or become aggravated as a result of performance of these duties, will be cause for rejection.
